K3 Travel AB – General travel terms for package tours
Definitions
The main traveler refers to the contracting party, which is always a legal entity. A traveler is an adult person with a legal relationship with the main traveler.
A ”package tour” refers to an arrangement designed according to a written agreement between K3 Travel AB (the organizer) and the end customer, consisting of the following parts: transport and accommodation or any of these services combined with other land and/or transport arrangements. Additionally, the arrangement must last more than 24 hours or include an overnight stay, and the arrangement is sold or marketed for a total price or with separate prices linked to each other.
1. The Agreement
1.1 The agreement becomes binding for the parties when the organizer has confirmed the main traveler’s booking in writing unless otherwise agreed. The organizer shall confirm the main traveler’s booking without delay. The right of withdrawal does not apply to package travel agreements.
1.2 The main traveler is the person in whose name the agreement has been made. The main traveler is listed first in the travel documents or in another clear manner. The main traveler is responsible for payment according to the agreement. All changes and any cancellations must be made by the main traveler. Exceptions can be made if the main traveler becomes seriously ill and cannot make the change or cancellation. The main traveler is responsible for providing the organizer with correct booking information for other travelers covered by the agreement. Any refunds are made to the main traveler.
1.3 Connecting travel or special arrangements are included in the package travel agreement only if they are booked together and at the same time as the services included in the package tour or if they are sold together with other services for a total price.
1.4 The organizer shall provide general information about passport and visa requirements.

1.6 Any requests or special services at the main traveler’s request are included in the agreement only if explicitly confirmed in writing by the organizer.
1.7 The main traveler is obliged to check the booking confirmation/travel documents as soon as they are received. The main traveler is responsible for ensuring that all information is correct, including that names are spelled correctly and match the passport. Any errors must be reported immediately. The organizer reserves the right to charge a fee corresponding to the actual cost of correcting incorrect information, along with reasonable compensation for the additional work the correction entails. If the error is due to the organizer or someone they have hired, the correction shall be made at no cost to the main traveler.
1.8 The main traveler shall immediately notify the organizer of any changes to the address, email address, phone number, or other information relevant to the organizer’s ability to contact the main traveler.
1.9 For certain trips, a minimum number of participants is required for the trip to be carried out. The main traveler shall be clearly informed of this no later than at the time of booking.
1.10 If flight tickets are part of the package tour, they must be used in the correct order. The traveler cannot use only a return ticket when both outbound and return have been booked or only part of a flight segment. If the ticket is not used from the start, the remaining parts will be canceled by the airline.
2. Price and payment
2.1 The price shall be stated in such a way that the total price of the trip is clearly indicated. The price shall include all services included in the agreement as well as mandatory supplements, taxes, and fees.
2.2 The main traveler shall pay the price of the trip no later than the time specified in the agreement.
2.2.1 An invoice for a deposit of 30% of the total amount of the trip shall be paid within seven (7) days after the confirmed offer. Full payment shall be received by the organizer no later than 45 days before departure according to the invoice for the remaining amount. Any additional payments are made according to an agreement with the organizer.
2.2.2 Please note that there may be special conditions for some of the organizer’s suppliers. These conditions are attached when booking the trips where they apply.
2.3 If the main traveler does not pay the price of the trip in accordance with the agreement, the organizer has the right to terminate the agreement and charge reasonable compensation.
2.4 The organizer is also obliged to inform the main traveler of any additional costs that may arise.
2.5 The organizer is not responsible for the accuracy of information provided on websites other than the organizer’s own. This also applies to pages linked from the organizer’s website.
3. Traveler’s right to change and cancel
3.1 The main traveler has the right to change the agreement if the organizer agrees. Changes to the agreement may incur additional costs for the main traveler from the organizer or others.
3.2 Cancellation costs and cancellation rules are stated in the booking confirmation for the booked package tour from the organizer.
3.3 If the main traveler has entered into an agreement for cancellation protection or cancellation insurance, the trip can be canceled in accordance with the terms applicable to the cancellation protection or cancellation insurance. Cancellation insurance is NOT included in the price of the trip.
3.4 Cancellation Protection:
3.4.1 Prices vary depending on the booked trip and must be taken out at the time of booking, before payment of the registration fee for the trip. Booked cancellation protection is non-refundable. It is not possible to take out cancellation protection after payment of the registration fee.
4. Changes before departure
4.1 Change of contract terms:
4.1.1 The organizer has the right to make changes to the agreement provided that the organizer informs the main traveler of the change in a clear, understandable, and explicit manner through a durable medium.
4.2 Change of price:
4.2.1 The organizer may increase the price of the trip if the increase is due to changes in transport costs, fuel costs, taxes, fees, customs duties, charges for certain services such as airport, port, landing, and take-off fees, and public charges or exchange rates.
4.2.2 The price of the trip may be increased by an amount corresponding to the main traveler’s share of the cost increase incurred by the organizer. The right to a price increase exists only if the cost increase exceeds 100 SEK per booking.
4.2.3 The organizer shall notify the main traveler of the price changes as soon as possible. The notification shall include a justification for the change and a calculation.
4.2.4 If the main traveler terminates the package travel agreement, the booking confirmation’s cancellation rules and costs apply.
4.3 Organizer’s and main traveler’s right to terminate the agreement in case of Force Majeure:
4.3.1 Both the organizer and the main traveler have the right to withdraw from the part of the agreement affected by force majeure. The main traveler has the right to withdraw from the agreement without paying any cancellation fee, just as the organizer has the right to withdraw from the agreement without the main traveler being entitled to any compensation.
4.3.2 The main traveler does not have the right to terminate the agreement if the events were generally known at the time the agreement was entered into.
4.3.3 To determine whether the event is of such a serious nature that it could be considered force majeure, expert Swedish or international authorities should be consulted. From 14 days before departure, a current travel advisory from the Ministry of Foreign Affairs is grounds for termination if the advisory covers the time of the main traveler’s trip. A current travel advisory from the Ministry of Foreign Affairs shall also be considered grounds for termination if it is otherwise clear that the circumstances underlying the advisory affect or will affect the destination at the time of the main traveler’s trip.
5. Organizer’s responsibility for the implementation of the package tour
5.1 If a travel service is not carried out according to the agreement, the organizer shall remedy the defect within a reasonable time. However, the organizer is not obliged to remedy the defect if it is impossible or if the remedy would incur disproportionate costs.
6. Complaints
6.1 The main traveler may only invoke defects in the agreed services if they notify the organizer or retailer of the defect within a reasonable time* after they noticed or should have noticed the defect. This should be done as soon as possible and, if possible, at the destination. When determining any price reduction or compensation for damages, the time when the main traveler complained is taken into account.
*Reasonable time is considered to be 14 days after the end of the trip.
7. Traveler’s responsibility
7.1 Organizer’s instructions:
7.1.1 The traveler is obliged to respect the rules of conduct that apply to the trip and at the destination and behave in such a way that fellow travelers or others are not disturbed. If the traveler significantly violates this, the organizer may terminate the agreement without the traveler being entitled to compensation or a refund. In such cases, the traveler is responsible for their own return transport and bears the costs incurred.
7.1.2 The traveler shall continuously keep themselves updated on departure locations and departure times, for example, by immediately after arriving at an airport checking information screens and contacting airport staff if in doubt about which terminal or gate the flight departs from. These details often change, which is beyond the organizer’s control.
7.2 Traveler’s responsibility for damage:
7.2.1 The traveler is responsible for any damages caused to the organizer due to the traveler’s negligence.
7.3 Traveler’s responsibility for formalities:
7.3.1 The traveler is responsible for observing the necessary formalities for the trip, such as holding a valid passport and any foreign passports, visas, nationality, dual citizenship, vaccinations, and insurance. The traveler shall immediately notify the organizer of any changes to the address, email address, phone number, or other information relevant to the organizer’s ability to contact the traveler.
7.3.2 The traveler shall follow the rules specified by the organizer for confirming flights, which are included in individual trips and package tours without a tour guide. Failure to confirm may result in the relevant airlines having the right to dispose of the reserved seats, and the traveler may lose the right to use the remaining flights.
7.3.3 The traveler shall have completed check-in for all transport services included in the package tour according to the travel plan or other instructions from the organizer or carrier.
7.3.4 The traveler is responsible for all costs incurred due to deficiencies in the mentioned formalities, such as return transport due to lack of a passport, unless the deficiencies were caused by incorrect information from the organizer or retailer.
7.3.5 The traveler is responsible for taking note of the information provided by the organizer.
7.4 Deviation from the arrangement:
7.4.1 A traveler who deviates from the arrangement after the trip has started is obliged to notify the organizer or their representative.
7.4.2 Some trips include a certain degree of hardship and unexpected events. Some of them also place certain demands on the participants’ physical condition. It is the traveler’s responsibility to choose a trip of such difficulty that they are convinced they can participate in all aspects of the trip. The participant participates at their own risk.
7.4.3 The organizer is not responsible for forgotten or lost belongings.
8. Organizer’s obligation to provide assistance
8.1 If the main traveler is in difficulty during the trip, the organizer is obliged to provide appropriate assistance without unnecessary delay. Such assistance may include information about health and medical services, local authorities, and consular support. The organizer has the right to charge a reasonable fee for such assistance if the situation was caused intentionally or by negligence on the part of the main traveler.
9. Force majeure
9.1 The organizer is not responsible for errors, delays, or other damages caused by law, government action or order, acts of war, strikes, natural disasters, or other similar circumstances or events beyond the organizer’s control.
9.2 If a circumstance according to the previous paragraph occurs, the organizer has the right to terminate the agreement. The main traveler or other travelers are not entitled to any compensation or damages.
10. Image material
10.1 The organizer reserves the right to take photos and videos. The image material that the organizer finds of interest may be published on the organizer’s website or social media. Close-ups are never published without the main traveler’s consent according to the European GDPR law.
11. Dispute resolution
11.1 The parties should try to resolve disputes regarding the interpretation or application of the agreement on their own. If the parties cannot agree, the dispute can be examined by the National Board for Consumer Disputes (ARN – www.arn.se), Box 174, 101 23 Stockholm, or by a general court.
